1. Agreement to Terms

By accessing or using the SpikeMyResume platform ("Service," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you are prohibited from using the Service and must discontinue use immediately.

2. Description of Service

SpikeMyResume is an AI-powered resume and career preparation application. Our services include analyzing uploaded resumes against job descriptions, calculating applicant tracking system (ATS) matching scores, identifying missing skills, generating tailored resume content, and predicting interview preparation questions.

3. Accounts and Registration

To use most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Credit Packs and Payments

Our Service operates on a credit basis. Users can purchase credit packs to unlock specific tools (such as resume analysis or tailoring).

• Payments are processed in Indian Rupees (INR) via our billing partner, Razorpay.
• Credits are non-transferable and possess no cash value.
• We reserve the right to change our credit packages, rates, or charge fees for parts of the service at any time.

5. User Submissions and Intellectual Property

You retain ownership of the resumes, text, job descriptions, and other materials you upload or enter into the Service. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to parse, process, and analyze your content solely for the purpose of delivering the Service to you.

All application code, UI designs, brand assets, and generated AI templates are the exclusive intellectual property of SpikeMyResume.

6. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Attempt to scrape, reverse engineer, extract source code, or bypass the rate-limiting of our APIs.
• Resell, sublicense, or share your account access with third parties.
• Upload malicious code, viruses, or offensive/inappropriate files.

7. Limitation of Liability

In no event shall SpikeMyResume, its developers, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, employment opportunities, or goodwill) arising out of or relating to your access to or use of the Service. We do not guarantee employment, interviews, or hiring results from using our platform.

8. Governing Law and Dispute Resolution

These Terms and Conditions and your use of the Service are governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India.
